Definition and Scope of Personal Data and Processing
Personal data refers to information that directly or indirectly determines an individual’s identity, offering information about his or her characteristics, behavioural patterns, affiliations and more. This category includes, inter alia, items such as names, contact details, unique identification numbers and online identifiers.
The term processing refers to the range of actions, whether manual or facilitated by automation, directed at personal data. This may involve activities ranging from the collection, recording, structuring and storage of data, to their modification, retrieval, cancellation, or eventual destruction.
Nature of Data Processing
Browsing Information
During routine operations, the infrastructure and software mechanisms of our website acquire specific personal data, intrinsically transmitted via standard Internet protocols. Although this data is not specifically collected to be linked to distinct individuals, its characteristics can potentially facilitate individual identification, especially when linked to third-party data. The main elements of this data are the IP addresses or specific domains of the devices of individuals accessing our site, the Uniform Resource Identifier (URI) details of the requested resources, the timestamp of the request, and other technical details related to the configuration of the individual’s system.
The main purpose of this data accumulation is to obtain anonymous statistics on the use of the platform, ensuring its optimal functioning and detecting any discrepancies or misuse. After this processing, the data is promptly deleted. However, under certain circumstances, this data may be used to determine liability for potential IT infringements involving Lion’s Paw AG or other entities.
Information Sent by the Individual
Lion’s Paw AG aggregates individuals’ data when they send a communication email or information request. This includes any personal information that individuals choose to include in their message, during a telephone or a personal meeting conversation.
Objectives of Data Processing
The individual’s personal data is collected and processed to meet the following business imperatives:
- Responding to and following up the requests made to Lion’s Paw AG by the individual;
- Ensuring compliance with all obligations (pre-contractual, contractual, administrative, legal and fiscal) that may arise from the potential association between the individual and Lion’s Paw AG;
- Providing the individual with relevant communications and service notices;
- Strict compliance with legal mandates, applicable regulations, established conventions and the requirements of the relevant regulatory body; and
- Exercising and safeguarding the property rights of Lion’s Paw AG, whether in the event of a dispute or not.
In certain cases, personal data may be collected from public sources (such as official company registers, press, and the internet) or third parties, including due diligence service providers (such as name checking databases, lawyers etc).
Lion’s Paw AG ensures that the collection of personal data is limited to the extent necessary for providing its services and fulfilling its obligations. The type and amount of personal data collected are kept in line with these requirements.
Legal Basis for Data Processing
Every case of data processing is supported by one of the following legal grounds:
- The processing is indispensable for the completion of a contractual agreement between the parties involved. Although in this scenario the submission of personal data remains discretionary, its absence precludes the completion of the contract and the subsequent provision of the desired services.
- Processing is required by law. In these cases, the provision of data is mandatory and failure to provide it would prevent the conclusion of the contract and the subsequent provision of services.
- The processing is in accordance with the good faith interests of the Data Controller, provided that these interests do not overshadow or violate the fundamental rights and freedoms of the individual, in particular with regard to the protection of personal data.
- Processing is subject to the explicit consent of the individual for clearly defined purposes. Under these circumstances, the provision of data remains discretionary, and the individual retains the prerogative to revoke previously given consent at his or her discretion. Lion’s Paw AG may refuse to follow the revocation in case of suspicion that the data collected may be relevant for AML purposes.
Data Disclosure
As part of the operations of Lion’s Paw AG and for the purposes described above, the individual’s personal data may be disclosed to:
- Designated data processors, appointed to perform specific or additional tasks for Lion’s Paw AG. The individual retains the right to request at any time an updated list of data processors whom Lion’s Paw AG can identify as such.
- Independent data processors, in accordance with legal provisions or mandates from authoritative bodies.
- Persons authorised by Lion’s Paw AG to process personal data, solely for activities intrinsically linked to the provision of the service, and who are bound by confidentiality, both legally and contractually. This includes Lion’s Paw AG employees and possible associated contractors.
Lion’s Paw AG has no intention of marketing, selling or distributing your personal data to external parties.
Data Storage
The personal data storage places are physical and digital, located in Switzerland.
Data Retention
Individual’s personal data are protected by current privacy regulations and bylaws. The minimum storage period after the conclusion of the contractual relationship is ten years. Resumes submitted by individuals for potential roles will be stored for no longer than 2 years after submission.
Nevertheless, in order to safeguard its interests, Lion’s Paw AG may extend the data retention period in line with current Swiss law.
Individuals’ Rights
As an individual, you have specific rights with regard to your personal data. At any time, you may request confirmation as to whether or not your personal data are being processed. In particular, you have the right to:
- Access: Obtain information on the purposes behind the processing, the potential recipients of the data, the intended retention period, and any implications of data profiling.
- Rectification: Request the amendment of any inaccuracies or incomplete aspects of your personal data.
- Cancellation: Request the deletion of your data when it is deemed unnecessary for the purposes originally intended by Lion’s Paw AG.
- Limitation: Request limitations to the processing of your data in the circumstances provided for by law.
- Data portability: Request the transmission of your data to another Data Controller, provided that it is in a universally accessible digital format.
- Objection: To object to specific aspects of the processing of your data and, in particular, to object to any decision based solely on automated processing, including profiling.
If you have any requests, questions, or concerns regarding this Privacy Policy or the processing of your personal data, please contact us at any time by sending an email to operations@lionspaw.ch.
In the event that the request is refused or if you are not satisfied with our processing, you have the right to lodge a complaint with the competent supervisory authority and seek a legal remedy. For individuals located in Switzerland, the competent authority is the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch).
